Paragraf 276

Jeg har fået en opgave, som jeg simpelthen bare ikke forstår. Opgaven handler om, at jeg skal skrive en fortolkning af straffelovens paragraf 276. Jeg læser ikke engang jura, så det er noget af en mundfuld. Opgavens titel er bare: ”Straffeloven § 276”. Det er vores lærer i samfundsfag, som engang læste jura – men aldrig fuldførte studiet – som har givet os opgaven. Han er helt vild med den slags. Men det hjælper mig jo ikke videre. Nu har jeg siddet og stirret på den paragraf i flere timer.

Handler om tyveri

Jeg forstår sådan set godt meddelelsen i teksten: Man er en tyv, hvis man tager en eller anden ting, der ikke er ens egen. Ok, så langt så godt. Tingen skal være rørlig. Ok. Det skal altså være en fysisk ting, man tager – eller stjæler. Fx et guldur eller en computer.

Men så er der en fortolkning af, hvad en ’rørlig ting’ er: En energimængde, der bruges til at frembringe lys, varme, kraft, bevægelse eller andet økonomisk øjemed. Og det er her, mine problemer opstår. Hvad med digitalt tyveri? Hvis jeg nu hacker ind på min samfundslærers computer og stjæler alle hans personlige oplysninger, så kan jeg jo bare købe ind med hans kreditkortoplysninger. Det er vel også økonomisk øjemed. Uden at tyveriet sådan set omfatter en fysisk genstand. Er digitalt tyveri ikke omfattet af paragraffen? Er der en anden paragraf, der udelukkende handler om digital kriminalitet?

Jeg er ikke med

Det er det, jeg ikke forstår. Eller også er der noget andet, jeg ikke forstår – eller ikke har set.
Jeg har endog ringet til en af mine klassekammerater. Hun forstår heller ikke helt opgaven. Men hun skriver bare en fortolkning, der går i retning af, at hun antager, at paragraffen bare handler om tyveri af fysiske genstande.

Jeg kan ikke lade være med at tænke, at det ville også være den nemme løsning. Men jeg er ærekær og vil have de gode karakterer. Så jeg tror, jeg vil skrive en masse om tyveri af fysiske genstande. Men så vil jeg tilføje en masse om digital kriminalitet – og om sikker brug af internettet.

Digitale tyverier?

Der kommer jo flere og flere oplysninger om digitale tyverier. Der kommer flere og flere skandaler, omkring at elektroniske data, der slipper ud. Senest fra Facebook tror jeg. Og det er jo stadigvæk nemt at stjæle oplysninger om mennesker. Jeg kender faktisk en del, som har været udsat for det. Så ja, jeg tror, at det er i den retning, at min opgave skal gå.

Jeg ved ikke, om jeg rammer rigtigt. Men jeg ved, at jeg kan lave en imponerende, flot opgave om tyverier på internettet. Og så pyt med om jeg ikke helt forstår straffeloven 276 opgaven.
Jeg begynder at lave mine noter og forsøger at sætte dem op i en logik, jeg selv kan forstå:
Introduktion til straffelovens paragraf 276, ændringer til paragraffen – et historisk overblik, fysiske og ikke-fysiske objekter, digitale tyverier – hvad er det?, digitale tyverier – eksempler. Og så vil jeg slutte opgaven af med skrive noget om udviklingen i digital kriminalitet.
